Terms of Service

These Terms govern your use of the Automa Foundry website, client portal and related services. By creating an account or using our services, you agree to them.
1. Who we are
Automa Foundry (“we”, “us”, “our”) is operated by Automa Foundry. We help small businesses and independent creators adopt AI tools and automate business processes. You can reach us at nathan@automafoundry.com.
2. Eligibility and accounts
- You must be at least 18 years old and able to enter a binding contract.
- If you register on behalf of a business, you confirm you are authorised to bind that business to these Terms.
- You must provide accurate information and keep it up to date.
- You are responsible for keeping your password secure and for all activity under your account. Tell us immediately if you suspect unauthorised access.
3. Our services
Our client portal lets you communicate with our team, raise requests and follow the progress of your work. Consulting, setup, automation or other paid services are described in a separate proposal, statement of work or order (a “Service Agreement”). If a Service Agreement conflicts with these Terms, the Service Agreement takes priority for that engagement.
4. Fees and payment
Access to the client portal is free unless otherwise agreed. Fees for paid services, payment terms and any refund arrangements are set out in the relevant Service Agreement or invoice.
5. Acceptable use
You agree not to:
- Use the services for anything unlawful, fraudulent, harmful or abusive.
- Upload or send content that infringes anyone's rights, or that contains malware.
- Attempt to access other users' accounts or data, or probe, disrupt or overload our systems.
- Resell, copy or reverse engineer the platform without our written permission.
6. Your content
You keep ownership of the messages, files and business information you share with us (“Client Content”). You grant us a limited licence to use Client Content only to provide, support and improve our services for you. You confirm you have the rights needed to share it.
7. AI tools and outputs
Many of the tools we recommend or configure use artificial intelligence, including third-party services. AI outputs can be inaccurate, incomplete or unsuitable for your situation. You are responsible for reviewing outputs before relying on them, particularly for legal, financial, medical, safety or customer-facing decisions. Third-party tools are subject to their own terms and pricing, which may change.
8. Intellectual property
The platform, our branding, templates, methods and materials remain our property. On full payment, deliverables created specifically for you are licensed or assigned as set out in your Service Agreement. We may reuse general know-how and non-client-specific techniques.
9. Confidentiality
We treat your non-public business information as confidential and use it only to deliver our services, except where disclosure is required by law. How we handle personal data is explained in our Privacy Policy.
10. Disclaimers
We provide our services with reasonable skill and care. Beyond that, and to the extent permitted by law, the platform is provided “as is” and we do not guarantee that it will be uninterrupted or error-free, or that any particular business result — such as revenue, savings or growth — will be achieved.
11. Limitation of liability
Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for indirect or consequential loss, or for loss of profits, revenue, data or business opportunity, and our total liability arising from the services is limited to the fees you paid us in the 12 months before the claim arose.
12. Suspension and termination
You may close your account at any time by contacting us. We may suspend or close accounts that breach these Terms or put our platform or other users at risk. Sections that by their nature should survive termination — including content ownership, confidentiality, disclaimers and limitation of liability — will continue to apply.
13. Changes to these Terms
We may update these Terms as our services evolve. If changes are material we will notify you through the portal or by email. Continuing to use the services after changes take effect means you accept them.
14. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, unless mandatory consumer law where you live says otherwise.
